STATEMENT OF RESPONSIBILITY AND TERMS AND CONDITIONS
BCD Travel only acts as an agent for airlines, hotels, bus companies, train service, tour operators, cruise lines, car rental companies, and other contractors providing accommodation, transportation, and other services. All such services are provided by independent suppliers and do not act for or on behalf of BCD Travel, are not employees of BCD Travel, and BCD Travel does not do business as joint ventures or otherwise. By using the company’s services, the client agrees and accepts that neither the company nor the parent company, affiliates and subsidiaries or representatives (collectively «BCD Travel Identities») shall be or become liable for any loss, cost, expense, injury, accident or damage to person or property resulting directly or indirectly from
- the acts or omissions of such suppliers, including, but not limited to, delays or cancellation of services, stoppage of operations, breakdown of machinery and equipment, or changes in prices, itineraries or schedules; and
- force majeure, incident to perils at sea, fire, acts of government or other authorities, war, acts of terrorism, civil unrest, strikes, riots, theft, epidemics, quarantines, or other diseases, climatic incidences, or any other cause beyond the control of BCD Travel.
NOTICE OF INCORPORATED TERMS AND CONDITIONS:
This notice forms part of the conditions of contract between the airline and the passenger. If there is any inconsistency between the terms incorporated herein and the terms and conditions on the passenger’s ticket, these incorporated terms govern.
The air carrier transportation to be provided is subject to the individual terms and conditions of the air carriers, which are incorporated herein by reference and form part of the contract of carrier. The incorporated terms and conditions may include, but are not limited to: (1) limits on liability for personal injury or death; (2) limits on liability for baggage, including fragile or perishable goods, and availability of excess valuation coverage; (3) restrictions on claims, including time periods in which passengers must file suit or bring an action against the airline; (4) the airline’s rights to change the terms and conditions of the contract; (5) rules on reconfirmation of reservations, check-in times, and refusal of carriage; and (6) the airline’s rights and limits of liability for delays or non-performance of service, including change of flight schedule, substitution of airlines or aircraft, and rerouting.
You may obtain additional information on points 1 to 6 above wherever the air carrier’s tickets are sold. You have the right to consult the full text of each air carrier’s terms at its airport sales offices and any other retail outlets. You also have the right, upon request, to receive free of charge the full text of the applicable terms incorporated by reference from each air carrier. Information on how to request the full text of each carrier’s terms is available wherever the carrier’s tickets are sold.
NOTICE
- FINAL DOCUMENTS: Please check the final travel documents when you receive them to ensure that your reservations are as requested and also to ensure that all documents are included. Report any discrepancies to us immediately.
- AIRPORT CHECK-IN: Be there with enough time for flight check-in and customs clearance. Airlines may set minimum check-in times at the airline check-in counter if you do not have a printed boarding pass and/or have to check baggage. Reservations are subject to cancellation if the minimum check-in time, as determined by that airline, is not met.
- HAZARDOUS MATERIALS: The carriage of hazardous materials such as aerosols, fireworks and flammable liquids on board aircraft is strictly prohibited. If you do not understand these restrictions, please obtain further information from your airline.
- FARES: Airfare, taxes and surcharges are subject to change prior to ticket issuance by the airlines.
- SCHEDULE CHANGES: Since many airline tickets are issued long before the actual departure date and schedule changes occur, we suggest that you contact the airline you will be travelling with to verify flight times.
- RECONFIRMATIONS: International regulations require reconfirmation directly with the airline at least 72 hours prior to departure or the reservation may be subject to cancellation. As airline schedules are subject to change without notice, it is suggested that the traveller always reconfirm reservations and contact the transporting airline for applicable requirements.
- OVERBOOKING: Airline flights may be overbooked and there is a small chance that a seat will not be available on a flight for which a person has a confirmed reservation. With few exceptions, people who are involuntarily denied boarding are entitled to compensation. Some airlines do not apply these consumer protections for travel from some countries, although other consumer protections may be available. The full rules for payment of compensation and boarding priorities for each airline are available at all airport ticket counters and boarding locations.
- DOCUMENTATION: Airport security regulations require all passengers to present acceptable photo identification (such as a National Identity Card, driver’s licence or passport) before boarding an aircraft. Check with the airline and your travel agent to obtain the proper documentation required for your flight.
- SEATING: Seat selection, based on traveller profile information, will be made whenever possible and included in the itinerary details. Specific seat numbers can be confirmed only if not previously assigned. Airlines reserve the right to release pre-selected seats if no check-in is made.
- CHANGES OR CANCELLATIONS: To change or cancel your flight itinerary, try to work with this travel agency. If you must work with the airline, ask them to apply the value of your unused ticket towards the purchase of a new ticket. If a refund is due, get a receipt from the airline. If you cancel, return unused tickets to this travel agent for possible credit or refund where applicable. If you are travelling on an e-ticket and miss your flight for any reason, call this travel agency or the airline immediately. Most special, excursion and discount tickets have various travel rules and restrictions that apply and actually carry a significant penalty (higher airfare or cancellation penalty) for change or cancellation, so be sure you understand these restrictions. Lost, stolen or destroyed tickets must be paid for until reimbursement is obtained from the issuing airline, subject to a service charge imposed by the airline. If you have guaranteed hotel reservations that you may wish to cancel, please notify the hotel as soon as possible and obtain the cancellation number. Deposits and advance payments are subject to the hotel’s cancellation policy.
- INSURANCE: Baggage insurance from airlines and other travel providers may have limited coverage. Your personal insurance may not adequately cover losses incurred due to cancellation, accident, illness, or stolen or damaged property. Ask your travel agent about travel insurance (available only at the time of booking), baggage, medical/hospital and accident insurance. A Travel insurance is recommended to cover these risks.
CONTRACT CONDITIONS
- For the purpose of this contract «ticket» means this ticket and baggage check of which these conditions and notices form part, «carrier» is equivalent to «carrier», «carrier» means all air carriers which carry or undertake to carry the passenger or his baggage hereunder or to perform any other service in connection with such carriage by air, and «WARSAW CONVENTION» means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw on 12 October 1929, or that Convention as amended at The Hague on 28 September 1955, as applicable.
- Carrier hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention, unless such carriage is not an «international carriage» as defined in that Convention.
- To the extent not in conflict with the foregoing, transportation and other services provided by each carrier are subject to (i) the provisions contained in this Ticket, (ii) the applicable tariffs, (iii) carrier’s condition of carriage and related regulations made a part hereof (and available upon request at carrier’s offices), except for transportation between a location in the United States or Canada and any location outside the United States or Canada to which the tariffs in effect in those countries apply.
- The name of the carrier may be abbreviated in the Ticket, the full name and its abbreviation being set out in the carrier’s tariffs, conditions of carriage, regulations or timetable; the address of the carrier shall be the airport of departure shown opposite the first abbreviation of the carrier’s name in the Ticket; the agreed stopping places are those set out in the ticket or as shown in the carrier’s timetable as scheduled stopping places on the passenger’s route; carriage to be performed thereafter by several successive carriers considered as a single operation.
- A carrier who issues a ticket for carriage on the routes of another carrier acts only as the agent of that carrier.
- Any exclusion or limitation of liability of the carrier shall apply to and inure to the benefit of its agents, employees and representatives, and in any event shall apply to BCD and its associated or related companies, and to any person whose aircraft the carrier uses for carriage, and their agents, employees and representatives.
- Checked baggage shall be delivered to the bearer of the baggage. In case of damage to baggage in international carriage, the complaint must be made in writing to the carrier immediately upon discovery of the damage and at the latest within seven (7) days after receipt; in case of delay, the complaint must be made within twenty-one (21) days after the date of delivery of the baggage. See rates or conditions of carriage with respect to non-international carriage.
- This ticket is valid for carriage for one year from the date of issue, except as otherwise stated in this ticket, the carrier’s fares, conditions of carriage or related regulations. The fare for carriage hereunder is subject to change prior to the commencement of carriage. Carrier may refuse carriage if the applicable fare has not been paid.
- The Carrier undertakes to use its best endeavours to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and do not form part of this contract. Carrier may, without notice, substitute alternative carriers or aircraft and may alter or omit stopping places shown on the ticket if necessary. Schedules are subject to change without notice. The carrier assumes no responsibility for making connections.
- The passenger must comply with the official travel requirements and present the required departure, entry and other documents, and arrive at the airport at the time indicated by the carrier or, if no time is indicated, sufficiently in advance to enable the passenger to complete the departure formalities.
- No agent, employee or representative of the carrier is authorised to alter, modify or waive any of the provisions of this contract.
- The carrier reserves the right to refuse carriage to any person who has purchased a ticket in violation of any applicable laws, regulations and fares.
LIMITATION OF LIABILITY: If the passenger’s journey involves a final destination or a stopover in a country other than the country of departure, the Warsaw Convention may apply to the entire journey, including any part within the country of origin or destination and, in most cases, limits the liability of carriers for death or personal injury and in respect of loss of or damage to baggage. Carrier-specific limits are available at all such carriers’ points of sale and can be reviewed upon request. Additional coverage can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier’s liability under the Warsaw Convention or special contracts of carriage.
